EDWARDSVILLE, Il. (KMOX)-U.S. Marshals are helping search for the teenaged gang member and suspected illegal alien, who is now charged with the weekend shooting outside a Pontoon Beach restaurant that left one man dead, another wounded.

17-year-old Fernando Gallegos-Ochoa is charged with two counts of first degree murder, one count of attempted first degree murder, one count of aggravated battery with a firearm and one count of aggravated discharge of a firearm.  He is not in custody.

Police say Gallegos-Ochoa shot Jesus Flores once in the head, and Luis Ortiz three times, after getting into an argument at La Mexicana Restaurant.

Flores died. Ortiz is expected to survive.

Madison County State’s Attorney Thomas Gibbons tells KMOX there are questions about Gallegos-Ochoa’s status, “There is some credible information at this point that he may be illegal. We’re still following up on that and will be working with our local and federal authorities on that issue.”

Gibbons says Gallagos-Ochoa also has no permanent address.

As for the gang ties, Gibbons says, “We are absolutely aware that the victims in this care are members of a street gang and have been prosecuted for some of their gang activities in the past. We believe that was a contributing factor in this particular case.”

Anyone with information on Gallegos-Ochoa’s whereabouts is urged to call Detective Mark Beckley at 618-931-5100, x215. Crimestoppers is offering a $1,000 reward. You can call them at 866-371-TIPS.
