Clay Waller Appeals 5-Year Sentence
CAPE GIRARDEAU, Mo. (AP) – Clay Waller is appealing the five-year sentence he received for threatening his missing wife’s sister.
The Southeast Missourian reports that Waller’s attorney filed the appeal Wednesday, a day after the sentence was handed down in federal court.
Jacque Waller of Cape Girardeau, a 39-year-old mother of 5-year-old triplets, has been missing since June 1 and is presumed dead. Authorities say her estranged husband is a suspect.
Clay Waller has not been charged in his wife’s disappearance, but pleaded guilty to the federal charge in October for threatening Cheryl Brenneke in an Internet posting.
Clay Waller had been hopeful for a sentence of less than a year in prison. A panel of three judges will decide if the sentence should be overturned.
