ST. LOUIS (KMOX) - A suit will be filed Monday against the Saint Louis Board of Police Commissioners and an unnamed officer. 24-year old Anthony Lamar Smith was shot and killed by Police in December after being pursued by officers.

Attorney Albert Watkins is representing Smith’s one year old daughter he says Smith was being pursued when he crashed his car.

Watkins is accusing the officers of planting a weapon in Smith’s car. Additionally, he claims the in-dash police camera was rolling throughout the incident. And Smith activated the OnStar feature and it was all recorded.

The FBI and the Justice Department are investigating. Watkins says the officer that shot Smith remains on desk duty in the St. Louis Police Department. He does not know the second officer’s status.

The suit will be filed in Federal Court Monday and alleges wrongful death and violation of civil rights.
