Trial Begins In Mistaken Identity Murder

KINLOCH, MO (KMOX) – The trial is scheduled to begin today for a teenager accused of driving the car used in the murder of a teen who was the twin brother of the intended target.

Justin Lewis was 16 years old on June 25, 2010 when prosecutors say he drove Kevin McDavis as they hunted down Derian Thomas.

When Lewis and McDavis thought the had found Thomas in a car in the 8100 block of Lurch in Kinloch, McDavis fired up to five shots into the car. But it wasn’t Derian Thomas who was shot in the head, it was his twin Darione.

Police say McDavis hunted down Derian because was jealous of the money Derian made in their lawn care business. McDavis is serving life in prison plus fifteen years after pleading guilty in May of 2011.

Lewis was indicted last March. He’s charged with second-degree murder and armed criminal action.
