ST. LOUIS, Mo. (KMOX) – Ameren-Missouri is asking a federal judge to dismiss a lawsuit by the US Environmental Protection Agency.

The case filed in January accuses the utility of modifying it’s Rush Island power plant in Festus without the proper permits.  The suit also alleges the utility failed to install equipment needed to reduce some emissions.

In a court filing this week, Ameren asserts the complaint is lacking facts and simply quotes regulations.  The company also claims the suit wasn’t filed within the statute of limitations.

Ameren has said the improvements to Rush Island were routine maintenance.  Federal regulators accuse the company of releasing pollution into the air by failing to install required controls.
