ST. LOUIS COUNTY (KMOX) – A new election has been ordered in the Democratic primary race that was not certified because some voters got the wrong ballots.

House members Stacey Newman and Susan Carlson ran against each other in the Aug. 7 primary after redistricting put them both in the new 87th District that covers part of St. Louis County. Unofficial tallies showed Newman won by one vote.

St. Louis County Circuit Judge Michael T. Jamison today ordered the new election to take place Sept. 24.

“The Court acknowledges that ordering a new election is an extreme remedy, which is to be used sparingly,” Jamison said.

The St. Louis County Board of Election Commissioners had previously told KMOX News 102 voters were given ballots for a different district. Officials are investigating how that happened but have said they believe it was a mistake and nothing suspicious occured.

St. Louis County Director of Elections Rita Heard-Days says this is the only fair way to solve the problem.

“This is what we requested to happen,” Heard-Days said. “After the irregularities were found, the election board found that we could not certify this election with those irregularities, that we needed to make sure we had a new election to make sure we were secure in those numbers.”

She says they’ve had a “frank conversation” with a supervisor who did many things wrong that day. When asked if that supervisor will be working during this new election, Heard-Days responded with a stern “no.”

She said district voters will be sent a letter explaining the new election date and the location of their polling places.

“It will work just like a normal election, the polls will open at 6, they will close at 7, we will have absentee ballots, so this is no different than a regular election,” Heard-Days said. “It’s just on a Monday.”
