MADISON COUNTY, IL (KMOX) – Following up with a KMOX report earlier this week, a Madison County judge upheld the suspension of the medical license of Alton, Ill., pediatrician, Dr. Gita J. Malur, after she failed to notify authorities of suspected child abuse.

Susan Hofer, spokesman with the Illinois Department of Financial and Professional Regulation, says in 2007 Malur’s patient was 2-years-old when he came to the emergency room at St. Anthony’s Health Center in Alton with bruises and possible human bite marks.

The Department of Family Services investigated the patient’s injuries but Malur told family services that she had no concerns for the patient’s health.

Three months later, the boy was back in the emerencgy room, but this time with a fractured sternum.

The boy was dead 10 days later.

Hofer says even though the doctor felt it wasn’t her responsibility to report each case of suspected abuse, the requirements are clear.

“Any time a healthcare professional, a teacher, an adult in a responsible situation sees anything that could be child abuse, it is their legal responsibility to report that possibility,” Hofer says.

The child’s death was eventually ruled a homicide. Malur’s one year license suspension begins next week.
