JEFFERSON CITY, Mo. (AP) – Ryan Ferguson was released from prison Tuesday night. Earlier a judge overturned Ferguson’s murder conviction in the slaying of a newspaper sports editor.

The Missouri Attorney General said Tuesday it would not retry Ryan Ferguson for the death of Columbia Daily Tribune sports editor Kent Heitholt.

An appeals court judge ordered Ferguson released from prison and into the custody of Boone County. The judge also ordered the county court to set conditions for Ferguson’s freedom within 48 hours, and around 7PM Tuesday, Ferguson was released.

Ferguson’s case has generated attention because his 2005 conviction came after his high school classmate testified that he had recalled from dreams several years later that the two of them were involved in Kent Heitholt’s slaying.
The appeals court ruled that Boone County prosecutors violated federal law by failing to share several pieces of evidence with Ferguson’s defense team.
