A St. Louis Circuit Judge Issues a Preliminary Injunction in Favor of the Saint Louis Firefighters Retirement System

ST. LOUIS (KMOX) –  A preliminary injunction has just been issued in favor of the Saint Louis Firefighters Retirement System. The City contends trustees for the pension system can not sue the City. But today’s ruling,  puts that suit on hold.

Attorney Dan Tobben, represents the pension fund and says the ordinance forbids funding of the present litigation and perhaps refuses access to court would violate both the Missouri Open Courts Doctrine which says you can’t forbid people to bring cases, in terms of lawsuits.

Tobben, argued the CIty of Saint Louis does not have the authority to enact Board Bill Eleven, which is the law that prevents the trustees from suing the City of Saint Louis over changes to the pension fund.
