Illinois Judge OKs Deal Over Gender On Birth Certificates

CHICAGO (AP)– A Cook County judge has approved an agreement making it easier for people who undergo sex changes to get a new birth certificate.  Judge Michael Hyman signed an agreement Tuesday between the state of Illinois and the American Civil Liberties Union that allows people to change the gender on their birth certificate even if they haven’t undergone genital reconstruction.

The ACLU sued over a Department of Public Health policy that made total reconstruction a requirement before updating a birth certificate. The ACLU says some sex changes don’t involve the genitals for medical or financial reasons. For instance, a woman transferring to a man might have breast-reduction surgery but nothing else.

The department changed its policy last year, but the lawsuit continued to ensure the department could not someday reverse course.
